over here. the fire started in a home near athens and peru just before 1:00 this morning. the fire quickly spread throughout the home and firefighters worked against the clock to keep it from spreading to neighboring buildings. now, one major challenge for fire crews was a gas rupture. it caused flames to shoot up to 10 feet high, but firefighters say they were able to get it under control. they called pg&e to come out and shut it off. now, the fire was contained and 2 a.m. we know now that three people were displaced as a result of the fire and two residents were taken to the hospital with nonlife-threatening injuries. back at the scene, we know that building inspectors and arson investigators are here. fire crews actually just lot of a few moments ago but an investigation will begin from here on out. reporting live in san francisco, cate caugiran, cbs 5. a south bay family is devastated by a weekend fire. three members of the family were killed in the fire inside a two-story townhouse on

bridgeport court on the west side of san jose. a couple and their 4-year-old granddaughter were trapped on the upper floor. firefighters arrived in minutes but the entire building was already engulfed in flames. >> this fire somehow got a really billing head start on us. it burned hot and it burned very fast. it consumed most of the apartment even within a three minute response time for us. >> two victims had lived in the complex for about 20 years. their granddaughter also died. another family member was reported to be in intensive care. two other people suffered smoke inhalation including a san jose police officer who tried to help the victims. 4:32 now. secretary of state hillary clinton is under observation at a new york hospital this morning because of a blood clot. her doctors discovered the clot yesterday in a follow-up exam following a concussion she had suffered earlier this month.

her spokesman says it's related to the concussion but is not saying where that clot is located. she is being treated with anticoagulants and will stay in the hospital for the next couple of days. the deadline is 16.5 hours away for the nation's lawmakers to reach some kind of compromise to avoid a so-called "fiscal cliff." the house is set to reconvene this morning at 6:00 pacific time. andrew spencer has more on why the process seems to have stalled. reporter: >> if there is an ultimate compromise, there will be parts of it that i find disgusting and reprehensible which i may have to swallow in the name of finding a compromise. >> reporter: a rare sunday session on capitol hill. >> the senate will come to order. >> reporter: as lawmakers work on avoiding the so-called "fiscal cliff." talks briefly hit a, quote, major setback on sunday over social security benefits according to a democratic source. but both sides agreed to push forward. >> i want everyone to know i'm willing to get this done. but i need a dance partner. >> reporter: vice president joe

biden is apparently that person for senate minority leader mitch mcconnell. top level sources say the two are taking over talks. if nothing is resolved by midnight, tax rates for all americans will increase and democrats say it means about $2,000 for the average middle class family. >> one mom said to me in michigan, that's four months groceries. that's commuting back and forth to work and gas for up to three years. i mean, that's a lot of money. >> reporter: democrats want higher taxes on families earning $250,000 a year and over. republicans want tax rates to stay where they are. taxes seem to be the biggest obstacle to a compromise but others want to government -- others want to see government spending put in check. >> the president is doing nothing about the addiction that his administration, he is the spender in chief. >> reporter: president obama says he is willing to do that. >> i offered over a trillion dollars in additional spending cuts so we would have $2 cuts for every $1 of increased revenue.

>> senate is in recess. >> reporter: the senate reconvenes at 11 a.m. so as americans celebrate the beginning of 2013 they may wake up wishing it was 2012 when they had more money in their pockets. andrew spencer reporting. >> the midnight deadline is 9:00 our time. if the deadline passes there could still be wiggle room if the president and lawmakers appear to be working towards an agreement. the tax hikes and spending cuts could be held at bay for a few weeks, they could be repealed retroactively once a deal is reached. and you can keep tabs on the fiscal talks anytime by logging on to our website, cbssf.com. there is some hope. congressional leaders showed yesterday they are able to compromise at least on a few things. top republicans and democrats announced they reached a deal to extend the 2008 farm bill for at least one more year. agricultural secretary tom vilsack says if an agreement had not been reached, milk prices would have skyrocketed stops $7 a gallon. the chp reports declines in

both drunk driving arrests and fatal accidents so far this holiday period. the numbers are in from the first two days of the new year's weekend. the chp made 723 drunk driving arrests since friday night across the state. that's more than 200 fewer than last year. accidents killed 9 people in california. down from 12 in the same period a years ago. here's a look at what bay area transit agencies are planning for tonight. caltrain free rides after 11:00 for passengers riding south from san francisco. muni will offer free rides from 8 p.m. until 6:00 tomorrow morning. in san jose and silicon valley, all vta bus and light rail will be free between 7 p.m. and 4 a.m. and bart will extend its service until 3 a.m. but no free rides. beautiful, isn't it?

towards san francisco. elsewhere the nimitz 880 in oakland fine past the coliseum. and all your drive times still in the green in the clear through the east bay. that's traffic. back to you guys. >> thank you. the search is on for the killer of a 15-year-old girl who was shot at an east oakland housing complex. it happened about 3:40 yesterday afternoon at 65th avenue and lion way. police say it appears the victim was walking with a group of people when a lone gunman approached them and then opened fire. a 14-year-old boy was also shot but his injuries are not considered life-threatening. witnesses told police the shooter appeared to be between the ages of 13 and 16. it brings oakland's homicide total to 131 for the year on this final day of 2012. that's a 27% increase from last year. san francisco has 67 murders for the year, a one-third increase over 2011 and san jose's 45 is relatively low for a steve almost a million people but -- for a city of almost a

million people but 12.5% higher than 2011. in contra costa county richmond has seen a dramatic decrease in homicides. 18 people having killed in richmond thisser. >> , the lowest number the city has seen since 2001. three years ago the city had 45 homicides. a likely factor is a big staffing increase at the richmond police department. it's gone from 40 officers to 190 in recent years. 4:40. drag-racing is suspected in a crash that injured three people in the east bay. an out-of-control car slamming into a busy funeral home on clayton road in concord. a 16-year-old was behind the wheel of a 1974 chevy nova. police say the teenager was going well over the 40-mile-per- hour speed limit and apparently racing another 16-year-old. a service was just beginning when the car crashed into the funeral chapel. >> literally five seconds after

i had entered the side room we thought it was an earthquake and saw the car careen into the building. i'm grateful to the priest for ushering everybody in. >> three people were injured. so far no arrests. checking bay area headlines, police are still looking for the person who mugged a woman and killed her dog in san francisco. the woman stopped her car in the tenderloin on friday when a man tried to rob her then grabbed her 12-year-old dog named roxy and threw it into traffic. police are checking for surveillance video of the area and are offering $1,000 reward for any information. the young woman charged in a hit-and-run death in san francisco is due back in court for arraignment this morning. police say 23-year-old gina eunice had four people on twin peaks earlier this month then left the scene. a woman she allegedly hit later died. tomorrow san francisco's minimum wage increases again.

angeles county... this is cell phone video taken at jackson this is pretty scary here. nearly a dozen people landed in icy waters in the mountains of los angeles county. this is cell phone video taken at jackson lake just south of lancaster. a couple witnessed a person fall through the ice. the thin ice, after sledding down the hill onto the lake. >> it was hard to watch.

it really was. we saw that guy go under three times and the third time we didn't think he was coming back up. >> people tried to help only to find themselves falling into the frigid waters. everyone in the water was eventually pulled out with a rope but six people were in that water. >> that's what happens, one tries to save the other. they're lucky they got out. >> a lot of people on the side there just helplessly watching. how are we doing new year's wise? >> i think we're doing pretty good. we had a lot of storms to round out the year but things settling down. cloudy skies this morning, kind of a chilly start to the day. we have a few clouds skirting on through. and then you can see more off the coastline. don't think that will be too bad but we'll see occasionally a few of those as we have lot to the day. partly cloudy this morning and chilly. new year's looking good. looks like we're going to start out the new year pretty much dry around the bay area although maybe late in the week we start to talk about some stormy weather but for today a cold front is approaching running into a ridge of high

pressure left behind a lot of sunshine, a couple of clouds but still cool temperatures outside. around the state, cold in the central valley, only about 51 in the afternoon in sacramento. 31 in lake tahoe. get this, overnight lows dropping down to minus 5 degrees if you are heading in that direction. throughout the day today our model wants to bring a couple of clouds across our skies and a mix of sun and clouds. then it moves out. new year's clear and no rain. temperature-wise we are going to especially keep the numbers down. 52 fremont, 51 pacifica, 52 morgan hill. east bay numbers upper 40s and low 50s so chilly. into the bay you will see those temperatures to 52 in oakland, 51 in petaluma and a cool 49 in sonoma. next couple of days looking into the new year can you believe that? yes indeed it looks like it will be mainly dry just a couple of passing weak systems on new year's day and then

still all free and clear. quick check of the south bay where the guadalupe parkway, 280 and 101 are still all moving at top speeds. back to you >> thank you. someone has reported will claimed the body of mass murderer adam lanza for burial. lanza was the gunman who opened fire earlier this month at that elementary school in newtown, connecticut. he then committed suicide. the north carolina times said the state medical examiner did not reveal who claimed his body. lanza reportedly lived with his mother, who was killed just before the school shooting erupted. nine people are dead after a tour bus plunged down an embankment in eastern oregon. state police say the bus crashed through a guardrail off interstate 84 near pendleton yesterday morning before it plummeted 100 feet. the freeway was covered with snow and ice at the time. more than 2 dozen were treated for injuries. they were on the way back for las vegas heading home to

vancouver. a psychiatric evaluation is ordered for the woman accused of pushing a man to his death at a new york subway station. erica menendez laughed hysterically during her weekend arraignment as she was charged with murder as a hate crime. prosecutors say menendez pushed a man on the tracks because she blamed muslims, hindus and egyptians for the 9/11 attacks. friends say the victim was hindu. the crash of a commercial jetliner in rubs. a russia. a camera shows the impact. debris flew across the road. amazing video. striking several cars. it happened as the plane slammed into the ground just short of the runway. five crewmembers were killed. there were no passengers on board. venezuelan president hugo chavez an outspoken critic of the united states has new complications following cancer

surgery in cuba. his vice president describes the venezuelan leader's condition as delicate. no other details were given about the complications that resulted from arrest spraer to infection. chavez is due to be important in for a new term in 10 days. a close call for an australian surfer when he encountered a shark. he was riding a wave when a shark struck has board. while he didn't get hurt, the 7- foot shark took a bite out of has surfboard. -- out of has surfboard. >> saw teeth on the bottom of the board and knocked me off my board. though. 4:50. another bay area county is banning plastic bags for shoppers starting tomorrow. the new ban applies to alameda county's unincorporated areas and all of its cities. stores will no longer be able to give customers one-time use plastic bags. customers must carry their own bags or pay 10 cents for each recyclable paper bag. as we prepare to say good- bye to 2012, we're also bidding a fond farewell to a parking park in san francisco. cbs 5 reporter patrick sedillo on why drivers will need a pocket full of change even on sunday. reporter: beginning next sunday, the free ride or should i say free parking is over. >> i don't see why they need to do it now. they are already getting you monday through friday and they have you on saturday now then they're going to get you on sunday. what are they going to do next, 24 hours a day? >> reporter: possibly. this woman says she knows why. >> the city needs money but not with the parking meter on

baby news from the kardashians. >> kim is with child apparently. that's what rapper kanye west said at a show in atlantic city in new jersey yesterday. he and kim kardashian have been dating for eight months. members of her family are tweeting the news this morning, as well. kim kardashian is still married to kris humphries although she filed for divorce more than a year ago. were you saying khloe is married? she can't have a kid. >> she has been trying. hopefully she does. >> hard to keep up with them. 150 years after signing the public is getting a rare look at the emancipation proclamation. >> the document aimed at freeing the slaves went into effect on january 1, 1863. it will go on the ground public display at the national archives in washington, d.c. tomorrow. when it was exited in michigan last year, people waited up to 8 hours to see it. it's part of history so people want to see it.
